The assignor assigns and agrees to assign to the lender as a continuing security for the payment or discharge of the secured sums: (a) all its right, title and interest in and to the legal charge dated 16 january 2002 whereby the colchester borough council charged land at brinkley grove road and mill road, colchester t/n EX676792 to the assignor; and (b) the benefit of all powers and remedies for enforcing it, (c) but subject to the assignor's right to redeem such assignment pursuant to clause 4 of the assignment.
