All monies due or to become due from the jasper slater partnership being a partnership between the jasper trust whose trustees for the time being are robert george davies, trevor newham and barnett waddingham capital trustees limited and the slater trust whose trustees are niall digby slater, trevor newham & barnett waddingham trustees limited to the chargee on any account whatsoever, notwithstanding anything to the contrary hereinbefore appearing, it is hereby expressly agreed and delcared by the parties hereto that each and every liability responsibility or obligation undertakin by the mortgagor hereunder shall be subject to the provision that barnett waddingham capital trustee LTD shall not incur any liability in respect thereof whether jointly or severally save to the extent that such liability shall not exceed in amount the value of the assets of the jasper trust and slater trust from time to time in its capacity as trustee of the plans
