All liabilities of the company to the chargee as trustee for itself and the other beneficiaries (as defined) whether or not originally owed to the beneficiaries (as defined) and whether owed jointly or severally or in any other capacity but excluding any sum or liability payment of which would be unlawful (the "seured liabilities")

By way of equitable mortgage its interest in any real property (other than the scottish property); by way of fixed charge all fittings plant equipment machinery tools vehicles furniture and other tangible moveable property; any investment; its goodwill and uncalled capital; any intellectual property; any monies standing to the credit of the rent account; and to the extent not otherwise subject to any fixed security in favour of the fund as trustee for the beneficiaries; any proceeds of any insurance of any charged property; and any amount received by the company as a result of any order of the court under sections 213, 214, 238, 239 or 244 of the insolvency act 1986; by way of fixed charge the rent and the benefit of any guarantee or security for the performance of payment of rent; and charged the debts to the fund as trustee for the beneficiaries by way of fixed charge; by way of floating charge the whole of its undertaking and property..
