All present and future obligations and liabilities of the company to the secured creditors (as defined) (or any of them) under the secured finance documents (as defined) together with all costs,charges and expenses incurred by the secured creditors (or any of them)
Short particulars
If at any time any subordinated creditor receives a payment (including by way of set-off) or distribution in cash or in kind of,or on account of,any of the subordinated liabilities contrary to the provisions of clauses 2 or 3 of the intercreditor deed the receiving subordinated creditors will hold the same in trust for and pay and distribute it or,in the case of a set-off,pay the equivalent amount upon demand to the security trustee for application in accordance with clause 9 of the intercreditor deed as if such receipt were the proceeds of enforcement of the security created by the security documents,provided that nothing in clause 6 of the intercreditor deed shall create or be deemed to create security..
