All moneys obligations and liabilities for the time being due, owing or incurred by the company and/or british van heusen company limited to the security trustee and/or the beneficiaries (or any of them) under or in connection with the finance documents in each case
Short particulars
Under the terms of the trade marks charge, as continuing security for the discharge of the secured obligations the company with full title guarantee hereby charges to the security trustee for itself and on behalf of the beneficiaries by way of first fixed charge, all right title and interest in and to the secured property; and all rights of action in relation to the secured property including the right to ask for and recover damages in respect of infringements of the trade marks wheresoever or howsoever occurring (all trade marks as defined in the appendix 3 attached to the form 395). see the mortgage charge document for full details.
