Brief description
By way of first legal mortgage over the leasehold land that is the subject of the sub-lease between john merchant macgregor, george macgregor and allan macgregor as partners of and trustees for the firm of binn skips dated 22ND and 25TH august 2005 and registered in the books of council and session on 7TH october 2005 as assigned by assignation by the teg group PLC in favour of teg environmental limited with consent of john merchant macgregor and others as partners of an trustees for the firm of binn skips and binn farm limited dated 24TH november 2009 and 13TH january 2010 and as varied by (1) minute of variation of sub-lease between john merchant macgregor and allan macgregor as partners of and trustees for the firm of binn skips, teg environmental limited, and the teg group PLC with consent of binn farm limited dated 21ST february and 5TH march 2013 and (2) assignation and variation of sub-lease among teg environmental limited, earnside energy limited, glenfarg organics limited and binn farm limited dated 24TH, 26TH and 28TH october 2016, all as registered at registers of scotland under title number PTH49061; together with all buildings and fixtures (including trade fixtures) and fixed plant and machinery at any time thereon; all easements, rights and agreements in respect thereof; and the benefit of all covenants given in respect thereof.. By way of first fixed charge over all other real property and all interests in real property (not charged by the above legal mortgage) other than any excluded property (as defined within the debenture deed).. By way of first fixed charge, all legal and/or equitable interest (including, without limitation, the benefit of all licences in any part of the world) of the chargor in, or relating to any patents, trade marks, service marks, designs, business names, copyrights, database rights, design rights, domain names, moral rights, inventions, confidential information, know-how and other intellectual property rights and interests (which may now or in the future subsist), whether registered or unregistered; and the benefit of all applications and rights to use such assets of the chargor (which may now or in the future subsist)..
