See clause 3.2 of the security agreement, which creates by way of first legal mortgage over the property and any rights (as defined in the security agreement) accruing to, derived from or otherwise connected with it (including insurances and proceeds of disposal (as defined in the security agreement) and of insurances)... See clause 3.3(a) of the security agreement, which creates by way of first fixed charge over all of the rights which the company now has and all of the rights which it obtains at any time in the future in property (as defined in the security agreement), other than that charged under clause 3.2.. property means:. (A) the property listed in schedule 2 (property) of the security agreement (namely the leasehold land at 73-75 pershore street, birmingham B5 4RW, title number MM80079);. (B) any other freehold, leasehold or commonhold land owned by the company in england and wales;. (C) any estate or interest in, and any rights attaching or relating to, that property; and. (D) any buildings, fixtures and fittings (including trade fixtures and fittings) and other equipment attached to, situated on or forming part of that property.
