Brief description
All and whole the ground floor shop with rear extension forming and known as 148 spital, aberdeen in the city parish of aberdeen and county of aberdeen which subjects hereby secured form part and portion of all and whole that tenement of twelve dwellinghouses and three shops known as 142, 144, 146 and 148 spital and 65 orchard street, aberdeen in the city parish and county foresaid (hereinafter referred to as “the said tenement”) erected on all and whole that piece of ground containing fourteen poles or thereby imperial measure lying on the east side of the street or road called the spital of aberdeen in the city parish and county aforesaid and being the piece of ground particularly bounded and described in and disponed by the disposition granted by the trustees acting under a trust deed by george godsman for behoof of his creditors and by the factor and commissioner for the said trustees in favour of aberdeen heritable securities and investment company limited dated the second and twelfth and recorded in the division of the general register of sasines for the county of aberdeen on the twentieth all days of june nineteen hundred and two; together with (first) a right in common along with the proprietors of the remainder of the said tenement to (one) the solum and foundations on which the said tenement is erected; (two) the external walls and gables of the said tenement, the internal division walls (so far as common to the subjects hereby secured and to the remainder of the said tenement), the roof and hatchway leading thereto, the chimneyheads (but excluding the chimneycans which shall be the property of the proprietors using same), the gutters, rhones, drains, water and soil pipes, gas pipes and electric cables and all other pipes and connections in so far as of mutual service to the remainder of the said tenement or any part thereof and to the subjects hereby secured with access thereto when required for the purpose of cleaning, maintaining, repairing and renewing the same and for all other necessary purposes and (three) the whole other rights, common and mutual, to the said subjects hereby secured and to the remainder of the said tenement; (second) a right of access to and egress from the toilet situated in the basement of the said tenement by the common entrance to the said tenement being 65 orchard street, aberdeen and the stair leading to the said basement; and (third) (one) the fittings and fixtures in and upon the said subjects hereby secured insofar as belonging to the owner and (two) the pertinents, rights and privileges effeiring thereto and the owner’s whole right, title and interest present and future therein.
