Brief description
All and whole the property now known as 28 high street, haddington, east lothian, EH41 3ES being the shop, the office on the ground floor forming the outshot and the piece of garden ground immediately to the east of same being the subjects more particularly described in and disponed by the disposition by mrs mary mccllelland or allison and miss mary stewart allison as executors of the late alexander allison and others in favour of britannic assurance company limited dated 20 and recorded in the particular register of seisins, reversions etc for the royal burgh of haddington on 31 december 1938 under exception of (first) all and whole that area of garden ground extending to one hundred and forty-one one thousandth parts of an acre or thereby lying to the south of the foregoing subjects and being the subjects described in the disposition granted by britannic assurance company limited in favour of the provost, magistrates and councillors of the royal burgh of haddington dated 24 june and recorded in the said division of the general register of sasines on 21 september, both in the year 1960, (second) all and whole that first flat above the street or ground level and known as 27 high street, haddington being the subjects described in the disposition by mrs jane diane bell in favour of muriel iris mackay, dated 20 and recorded in the said division of the general register of sasines on 25, both february 1974, and (third) all and whole the second floor flat above the street or ground level known as 27A high street, haddington with the attics above as described in the disposition by mrs jane diane bell in favour of adam johnston and colin stewart as trustees for their firm of messieurs johnston and stewart, architects dated 20 and recorded in the said division of the general register of sasines on 24, both june 1974 as such whole property is shown edged red on the plan; together with (one) the parts, privileges and pertinents; (two) the fixtures and fittings in and upon the property; (three) a right in common along with the whole other proprietors of the tenement to the solum on which the tenement building is erected (under exception of the solum of the offices on the ground floor to the rear of the tenement which is exclusively part of the property); (four) a right in common to the whole other rights common and mutual to the tenement; (five) a right in common with the other proprietors of the tenement to the common passage leading from high street shown in brown on the plan; and (six) the seller's whole right, title and interest present and future in and to the property disponed.
